IPEC Trial Ruling – Well Lead (ClearPetra®) v CJ Medical™
IPEC Trial Judgment Confirms CJ Medical™ can continue to Import and Distribute Seplou FANS™ as Well Lead owned ClearPetra® Patent Found to be Partially Invalid
CJ Medical™ Limited has been involved in legal proceedings before the Intellectual Property Enterprise Court (IPEC). The Claimant and ClearPetra® Manufacturer Well Lead Medical Co., Limited (“Well Lead”), a Chinese developer, manufacturer, and distributor of medical devices, brought proceedings against CJ Medical™ for infringement of its European Patent No. 3 760 143B1 (the Well Lead Patent). The claimant alleged that its patent was infringed by the Seplou Ureteral Access Sheath with Suction Collection (the “Seplou Sheath”), of which CJ Medical™ is the exclusive UK importer and distributor.
CJ Medical™ denied the allegations that the Seplou Sheath infringes the Well Lead Patent. Additionally, CJ Medical™ challenged the patent, which it considered to be invalid.
Following a hearing before the IPEC on 3rd and 4th February 2025, His Honour Judge Hacon found that the patent was partially invalid. His Honour also held that the claim of the patent that is valid is infringed by only the 14 Fr Seplou Sheaths. The 10, 11, 12, and 13 Fr sizes of the Seplou Sheath were held to not infringe. Accordingly, with the exception of product codes SPAS1435S and SPAS1445, C J Medical™ may continue supplying the Seplou Sheath without restriction.
