Well Lead Medical and CJ Medical Resolve UK Patent Dispute over FANS

Following the handing down of the judgment of His Honour Judge Hacon on 7 March 2025 in a patent dispute in London's Intellectual Property Enterprise Court, Well Lead Medical Co., Limited and CJ Medical Limited have reached an amicable resolution of their differences.

The dispute concerned Well Lead Medical's European Patent (UK) No. 3 760 143 (the "Patent") for a ureteral access sheath for use in the treatment of kidney stones. The Patent's claims are to sheaths that utilise suction for the removal of stones and stone fragments (claim 1) and to a suction sheath with a highly flexible tip, i.e. FANS (claim 3). Well Lead Medical has commercialised the Patent through its ClearPetra range of sheaths. CJ Medical is a UK importer and distributor of a range of competing suction sheaths with flexible tip made by Seplou, Inc. (the "Seplou Sheaths"). Well Lead had asserted in the dispute that the Seplou Sheaths infringed claims 1 and 3 of the Patent. CJ Medical denied infringement and

counterclaimed that the Patent was invalid.

HHJ Hacon's judgment held that claim 1 of the Patent was invalid but that its claim 3was valid and infringed by the 14 French Seplou Sheath (but not by the 10 French to 13 French versions).

Well Lead Medical and CJ Medical have agreed terms including that neither party will appeal the judgment and that enable CJ Medical to continue selling all versions of the Seplou Sheath without restriction. The Patent will continue in force in the UK with its claim 3 to FANS becoming its main claim.
